Linda and NSTA leaders and members,
I have a big issue for you.  I've been talking to a labor lawyer.  Long term subs (LTS), while working at per diem rates are not "professional employees" as defined by federal law because they don't get an annual salary.  Therefore, they are entitled to overtime pay but very few school districts or sub outsource agencies are obeying this federal law.  Long term subs have to grade papers, prepare lesson plans, make copies, prepare the classroom, etc.  All who have done this know that it requires working usually 45-55 or more hours per week -- but we only get paid for 37.5.  That's illegal.  

Please advise all long term subs to:
1. Each and every week, keep a written record of all of their hours worked, including the normal 7.5 hours per day (37.5 hrs per week) that most LTS and full time teachers work and that LTS subs get paid for, any hours worked over 37.5 but less than 40 per week, for which they are legally entitled to straight time pay, and any hours worked over 40 per week, for which they are entitled to time and a half overtime pay under federal law and the laws of most states.
2.  Submit any unpaid hours to their employer for payment.
3. If their employer does not pay them for all of their hours worked, they should contact the US Department of Labor - Wage and Hours Division to file a complaint.
